3 เมื่อข้อกำหนดพินัยกรรมซึ่งตั้งผู้จัดการมรดกไว้ไม่มีผลบังคับได้ด้วยประการใด ๆ การตั้งผู้จัดการมรดกนั้น ถ้ามีข้อกำหนดพินัยกรรมก็ให้ศาลตั้งตามข้อกำหนดพินัยกรรม และถ้าไม่มีข้อกำหนดพินัยกรรม ก็ให้ศาลตั้งเพื่อ  ในกรณีที่ไม่มีพินัยกรรม ทายาทสามารถยื่นคำร้องขอแต่งตั้งผู้จัดการมรดกต่อศาลได้ หากไม่มีผู้จัดการมรดกหรือหากพินัยกรรมไม่ได้ระบุไว้ ศาลจะเป็นผู้แต่งตั้งผู้จัดการมรดกตามที่เห็นสมควร โดยอาจเป็นทายาทหรือบุคคลที่เ  เมื่อเจ้ามรดกเสียชีวิตโดยไม่มีพินัยกรรม ทายาทจะต้องดำเนินการตามขั้นตอนทางกฎหมาย เพื่อให้การแบ่งมรดกเป็นไปอย่างถูกต้องตามที่กฎหมายกำหนดไว้ ซึ่งขั้นตอนหลัก ๆ มีดังนี้ ยื่นคำร้องขอเป็นผู้จัดการมรดก ผู้ที่มี  ในกรณีที่ไม่มีพินัยกรรม ทายาทสามารถยื่นคำร้องขอแต่งตั้งผู้จัดการมรดกต่อศาลได้ หากไม่มีผู้จัดการมรดกหรือหากพินัยกรรมไม่ได้ระบุไว้ ศาลจะเป็นผู้แต่งตั้งผู้จัดการมรดกตามที่เห็นสมควร โดยอาจเป็นทายาทหรือบุคคลที่เ  ถ้าไม่มีพินัยกรรม ต้องเริ่มอย่างไร เมื่อเจ้ามรดกเสียชีวิตโดยไม่ทำพินัยกรรมไว้ ญาติผู้เกี่ยวข้องสามารถดำเนินการฟ้องคดีมรดกเพื่อ ขอศาลตั้งผู้จัดการมรดก ได้ โดยมีขั้นตอนดังนี้ 1 ยื่นคำร้องขอตั้งผู้จัดการมรดก
